Terms of Service

These Terms of Service ("Terms", "Agreement") constitute a legally binding agreement between you and the operator of the Based Bot ("the Service", "we", "us") governing your access to and use of the Service. By accessing, installing, or interacting with the Service in any capacity, you represent that you have read, understood, and agree to be bound by these Terms in their entirety. If you do not agree to these Terms, you must immediately discontinue all use of the Service.

1. Acceptance and Binding Effect

Your use of the Service constitutes your full and unconditional acceptance of these Terms and any policies, guidelines, or supplemental terms incorporated herein by reference. These Terms supersede any prior agreements or representations, whether written or oral, relating to the subject matter hereof. We reserve the right to amend these Terms at our sole discretion; continued use of the Service following any such amendment constitutes acceptance of the revised Terms.

2. Eligibility and Platform Compliance

Use of the Service is conditioned upon your compliance with all applicable platform terms, including without limitation the Terms of Service and Community Guidelines of Discord, Inc. By using the Service, you represent and warrant that you meet all eligibility requirements imposed by the Discord platform applicable in your jurisdiction, and that your use of the Service will at all times comply with applicable law. We reserve the right to suspend or terminate access for any user or guild we reasonably believe to be in violation of applicable platform terms or these Terms.

3. Description of the Service

The Service is an automated software agent providing a range of functionality within supported Discord environments, including but not limited to AI-powered conversational assistance, content generation, guild administration tools, moderation utilities, and voice-interactive capabilities. The specific features available at any given time are subject to change and may vary by deployment configuration.

Certain features of the Service incorporate third-party artificial intelligence models and infrastructure. The availability, accuracy, and behaviour of such AI-powered features are subject to the terms and operational constraints of the applicable third-party providers and are outside our direct control.

4. Acceptable Use

You agree to use the Service solely for lawful purposes and in a manner consistent with these Terms, applicable law, and applicable platform guidelines. Without limiting the generality of the foregoing, you agree not to use the Service to:

Engage in any conduct that violates or encourages violation of applicable law, regulation, or third-party rights;
Submit, generate, transmit, or facilitate content that is unlawful, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable;
Attempt to probe, scan, or test the vulnerability of the Service or any associated systems, or to circumvent any security or access controls;
Reverse-engineer, decompile, disassemble, or otherwise attempt to derive the source code or underlying infrastructure of the Service;
Circumvent, disable, or otherwise interfere with any usage limitations, rate controls, or access restriction mechanisms;
Engage in any conduct that could reasonably be expected to damage, disable, overburden, or impair the Service or its associated systems;
Generate, transmit, or distribute content that infringes any third-party intellectual property, privacy, or other proprietary rights.

We reserve the right, in our sole discretion, to restrict, suspend, or permanently revoke access to the Service for any user or guild at any time and without prior notice.

5. AI-Generated Content and Outputs

Certain features of the Service produce outputs generated by third-party artificial intelligence systems. Such outputs are provided on an informational basis only and are subject to inherent limitations including, without limitation, inaccuracy, incompleteness, and potential unsuitability for particular purposes. AI-generated outputs do not constitute professional, legal, medical, financial, or any other form of regulated advice, and should not be relied upon as such.

All responsibility for any use, dissemination, or reliance upon AI-generated content lies solely with the user. We expressly disclaim any liability arising from your use of or reliance on any content generated or facilitated by the Service.

6. Fair Use and Rate Limitations

In order to ensure equitable access and operational stability, the Service may impose usage limitations, rate controls, or cooldown periods on certain features. Such controls are a material component of the Service's design. Any attempt to circumvent, abuse, or exploit these controls constitutes a material breach of these Terms and may result in immediate suspension or termination of access.

7. Administrative Configuration and Privileged Access

Guild administrators bear sole responsibility for the configuration, deployment, and use of the Service within their respective Discord environments. The Service operator retains the right to exercise certain override and administrative capabilities that supersede guild-level configurations, and such exercise shall not constitute a breach of any obligation to guild administrators or their members.

8. Service Availability and Modifications

The Service is provided on an "as available" basis. We make no representations or warranties concerning the availability, continuity, or uninterrupted operation of the Service. We reserve the right, at our sole discretion and without liability or prior notice, to modify, suspend, restrict, or permanently discontinue the Service or any feature thereof at any time.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, RELIABILITY, NON-INFRINGEMENT, OR CONTINUOUS AVAILABILITY. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE SERVICE OPERATOR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, LOSS OF GOODWILL, OR ANY OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, REGARDLESS OF THE CAUSE OF ACTION OR THE THEORY OF LIABILITY, AND EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

11. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with applicable law. Any dispute, controversy, or claim arising out of or relating to these Terms or the Service shall first be subject to good-faith negotiation between the parties. Nothing in these Terms shall be construed to limit any right of injunctive or equitable relief available to either party.
